Rules for any sweepstakes in Alabama

  • Lottery and gift enterprise prohibition (Ala. Const. 2022, section 65): [S8]
    What the rule requires

Section 65 of the Constitution of Alabama of 2022 provides: “The legislature shall have no power to authorize lotteries or gift enterprises for any purposes, and shall pass laws to prohibit the sale in this state of lottery or gift enterprise tickets, or tickets in any scheme in the nature of a lottery” (S8). The Legislature's own bill synopses restate the rule: “Under Section 65 of the Constitution of Alabama of 2022, lotteries and gift enterprises are prohibited.” Proposals in 2026 to amend Section 65 (SB 257 and HB 448) proposed authorizing a state lottery and, in SB 257, in-person casino-style games and in-person and online sports wagering; neither text mentions sweepstakes (SB 257 text: S1; HB 448 synopsis: S2).

Notes

Read the 3 research notes
  • Private lawsuits: trade press reported on January 7, 2026 that sweepstakes casino operators faced 21 new lawsuits in Alabama, bringing the total to over 40, as residents sought to recover losses; discussing one of those suits, the report describes Ala. Code section 8-1-150. These are private suits, not state enforcement (S4, secondary). As published by the Legislature, section 8-1-150 makes contracts founded on a gambling consideration void, lets a person who paid money or delivered a thing of value lost on a game or wager recover it by an action commenced within six months, and lets any other person recover it by an action commenced within 12 months “for the use of the wife or, if no wife, the children or, if no children, the next of kin of the loser” (S7). The trade report's description of who keeps a recovery differs from that text.
  • A search of the Attorney General's site for “sweepstakes” on 2026-10-03 returned scam warnings and an August 22, 2017 release (S5, S6). That release announced a Jefferson County circuit court ruling that machines at a Birmingham facility, whose software “included illegal sweepstakes games in conjunction with online auctions,” operated as slot machines under Alabama law, and a cease-and-desist letter to Blue Streak Bids, LLC, operator of Redibids.com, whose website the office said offered the same games. That 2017 action predates the period this record covers (2022 onward), and the release does not describe a dual-currency model (S6).
  • Our crackdown timeline does not mention Alabama; nothing here conflicts with it.

What we could not establish

  • The Alabama Legislature's bill search, queried on 2026-10-03 through the data service its search page uses, returned no 2025 or 2026 Regular Session bill for “sweepstakes” (S9); the site does not say whether that search reaches full bill text. The gambling bills it returned include SB 257 and HB 448 (2026) and HB 41 (2025); HB 41 proposed raising gambling penalties and specifying that electronic games of chance, including electronic bingo, are illegal gambling devices. None of those texts mentions sweepstakes (S1, S2, S10).
  • Ala. Code section 8-1-150 is quoted from the Legislature's code database (S7); we did not review court rulings on whether or how it applies to online sweepstakes casinos.
  • We found no Alabama gaming regulator with authority over online play; the regulator field points to the Attorney General's consumer complaint page (S3). We found no Attorney General letter, suit or settlement aimed at online sweepstakes casinos in the sources checked on 2026-10-03.
