Rules for any sweepstakes in Colorado

  • Gambling definition (C.R.S. 18-10-102(2)): [S1]
    What the rule requires

Colorado defines gambling as risking any money, credit, deposit or other thing of value for gain contingent in whole or in part on lot, chance, the operation of a gambling device, or the outcome of an event the person cannot control. Listed exceptions include bona fide contests of skill, speed, strength or endurance, bona fide business transactions valid under contract law, and other acts expressly authorized by law.

  • Simulated gambling devices and internet sweepstakes cafes (C.R.S. 18-10.5-101, 18-10.5-102): [S1]
    What the rule requires

Article 10.5 of title 18 regulates simulated gambling devices. Its legislative declaration describes machines that enable gambling through pretextual sweepstakes relationships tied to the sale of internet services, telephone cards and other products at business locations known as internet sweepstakes cafes, and the article defines a simulated gambling device as one that displays simulated gambling at a business location. The text we read addresses devices at business locations, not apps or websites used from home.

Notes

Read the 2 research notes
  • The General Assembly's bill search for the subject Gaming, Lottery and Racing lists five 2026 measures (SB26-131 Sports Betting Protections, SB26-117 lottery ticket sales, SB26-163 Regulation of Gaming and Sports Betting, HB26-1370 limited gaming fund transfers, HCR26-1001 charitable gaming) and three 2025 bills on lottery and gaming funds and sports betting deductions; none concerns sweepstakes casinos (S2, S3). A sitewide search for sweepstakes returns two items, both from 2018: HB18-1234, an act titled Internet Sweepstakes Cafe Revise Legal Terms, and a Legislative Council Staff publication titled Gaming and Internet Sweepstakes (18-03) (S4). A keyword search of bills for sweepstakes in the 2025 regular, 2025 extraordinary and 2026 regular sessions returned no bills (S7).
  • SB26-163, enacted in 2026, lets Division of Gaming investigators inspect premises where they suspect unlicensed gaming or unlicensed sports betting; its summary does not mention sweepstakes or online casinos (S5).

What we could not establish

  • An aggregator claim that Colorado's Attorney General sent cease-and-desist letters to 14 sweepstakes operators in November 2025, and a claim that two 2026 sweepstakes ban bills failed in the Senate, could not be matched to any primary document. A site search of coag.gov for sweepstakes on 2026-10-03 returned two unrelated items (S6), and the legislature's 2026 gaming-subject list contains no such bills (S2). Neither claim is used.
  • The Division of Gaming site search (sbg.colorado.gov/search) returned no results for sweepstakes on 2026-10-03, but it also returned no results for the control term sports, so it was not a usable check of that site.
  • The statute text comes from the Colorado Revised Statutes 2024 uncertified printout; the 2025 title 18 printout was not available at the URL pattern we tried, so later amendments, if any, are not reflected.
