Rules for any sweepstakes in Florida

  • Registration, trust account or bond, winners list (Fla. Stat. section 849.094(1), (3), (4) and (5)): [S4]
    What the rule requires

An operator of a game promotion (defined to include a sweepstakes conducted in connection with the sale of consumer products or services) whose announced prizes total more than $5,000 must file its rules and prize list with the Department of Agriculture and Consumer Services at least 7 days before the start, and must fund a trust account or post a surety bond equal to the total prize value. The operator must later file a certified list of winners of prizes worth more than $25 and give a copy free to anyone who asks.

  • No purchase requirement (Fla. Stat. section 849.094(2)(e) and (8)(b)): Section 849.094(2)(e) makes it unlawful for a game-promotion operator “To require an entry fee, payment, or proof of purchase as a condition of entering a game promotion.” Section 849.094(8)(b) adds that compliance with the department's rules is not a defense to a slot machine charge or a violation of any other law. Notes

Read the 6 research notes
  • Timeline check: our crackdown timeline says Florida's Attorney General sued Stake.us and VGW brands on August 19, 2026 in Hillsborough County, naming payment processors, citing press coverage. The Attorney General's release and both complaints as filed (e-filed August 19, 2026) are now on the office's own site and agree with that entry (S1, S2, S3).
  • Timeline check: the timeline lists Florida among states where bills failed. The Florida Senate's own bill pages agree: every 2025 and 2026 bill listed here died (S5, S7, S10, S13, S15, S17).
  • None of the 2025 or 2026 bill texts listed above uses the word sweepstakes; they define “Internet gambling” by its features. Whether a given platform would have fallen within that definition is not something the bill pages state.
  • The Florida Gaming Control Commission's February 3, 2025 cease-and-desist letters went to three overseas bookmakers and casinos (BetUS, Bovada and MyBookie), not to sweepstakes casinos, per the Commission's release (S20). The Commission's news page links the Attorney General's August 19, 2026 release (S21).
  • Press reports in January 2026, citing Florida Politics, said the Attorney General had “issued subpoenas” to several fantasy platforms and “sweepstakes-style gaming apps” and planned to meet with operators early in 2026. The recipients and dates were not published in the sources checked, and the Attorney General's news-release list, read back to March 2024 on 2026-10-03, has no release on those subpoenas (S22, secondary; S24).
  • The Attorney General's June 10, 2026 release on a Lee and Collier County machine operation adds that the office “notified payment processors that their facilitation of illegal online gaming may implicate Florida’s RICO act”. It links the letter to Visa only through an X post, which we did not retrieve, and it does not mention sweepstakes casinos (S23).

What we could not establish

  • Court docket status for the two August 19, 2026 complaints was not checked; the case numbers are blank on the copies posted by the Attorney General. Status is recorded as pending because we found no report of a ruling or dismissal in the sources checked on 2026-10-03.
  • The Attorney General's September 25, 2026 letters to Google, Meta, Reddit, Snap and TikTok were not found on myfloridalegal.com's news-release list on 2026-10-03, and the X post that announced them was not retrievable without a browser; that entry rests on secondary reporting (S19).
  • We did not survey local or county actions against physical sweepstakes parlors, which are outside the scope of this record.
