Notes

- SB 3281 SD1 (2026) would have created the offense of promoting an illegal electronic gambling device, a class C felony, defining such a device as "any machine; table; device commonly known as a fish game, fish table, or fishing game; sweepstakes gaming machine; or a similar electronic gambling device" that awards anything of value based in whole or in part on chance, and would have added nuisance remedies against premises (S2). Its findings refer to fish games "along with sweepstakes gambling machines and similar devices" proliferating across communities. It passed the Senate 25 to 0 on March 10, 2026; the House Committee on Judiciary and Hawaiian Affairs recommended deferral on March 18, 2026, the last action shown on October 3, 2026 (S3). Its text does not mention online play, the internet or dual-currency systems, and its remedies concern devices and premises, so we do not list it as a bill on online sweepstakes casinos. A Sweepsy report of March 19, 2026 (secondary) said its loose definition could have reached dual-currency gambling used by online sweepstakes casinos (S8).
- Timeline check: our crackdown timeline lists Hawaii among states where bills "failed or died", a tally it says was compiled from trackers and trade coverage. In the Legislature's 2025 and 2026 measure status reports, no measure's title or description mentions sweepstakes (S1); among the gambling-related measures whose text we opened, only SB 3281 uses the word in a prohibition (S2). We found no Hawaii measure addressed to online sweepstakes casinos or dual-currency games. If the timeline's Hawaii entry refers to SB 3281, that bill concerns physical machines.
- Under HRS section 712-1223, "A person commits the offense of gambling if the person knowingly participates in any gambling activity", and "Gambling is a misdemeanor" (S5). This is general gambling law; we do not assess its application to any sweepstakes.
- Other 2025 and 2026 gambling-related measures concern sports wagering, casino licensing, a lottery and gaming corporation, prediction markets, nuisance abatement, social gambling and forfeiture (S1). HB 1434 (2025) would have let a proposed lottery and gaming corporation offer "legally compliant free-play games and sweepstakes" with Hawaii-related prizes to people outside Hawaii (S6).
- The Hawaii Attorney General is among the attorneys general listed as joining an August 2025 multistate letter urging the U.S. Department of Justice to help address illegal offshore gaming, per the Alaska Department of Law's release (S7). The release does not mention sweepstakes, so we do not list it as an action aimed at sweepstakes casinos.
What we could not establish
- Measure coverage is the Legislature's status reports matched on titles and descriptions (S1); full texts were read only for SB 3281, HB 1308, HB 2570, HB 2198, HB 1466 and HB 1434.
- The Department of the Attorney General and the Office of Consumer Protection sites were not searched for sweepstakes-casino actions.
