Notes

Read the 3 research notes
  • Article III, section 20 of the Idaho Constitution states that gambling is contrary to public policy and strictly prohibited except a state lottery, pari-mutuel betting, and charitable bingo and raffles conducted under enabling legislation, and that none of those permitted activities may employ casino gambling or any electronic or electromechanical imitation or simulation of casino gambling (S1). The provision does not mention sweepstakes or dual-currency games.
  • The Idaho Legislature's 2025 and 2026 legislation indexes list lottery appropriation and lottery rule bills and a 2026 bill on bulk lottery ticket purchases (H0504), but no bill whose index entry mentions gambling, casinos, wagering or sweepstakes (S4, S5).
  • Operator documents retrieved on October 3, 2026 list Idaho among excluded states, for example Chumba Casino's Sweeps Rules version 26.1 (S6), McLuck's Terms of Service version 2.6 (S7) and Stake.us Terms version 18.0 (S8). These documents do not state a reason for the exclusion.

What we could not establish

  • No Idaho Attorney General action aimed at online sweepstakes casinos was found. Site searches of ag.idaho.gov for sweepstakes and online casino on 2026-10-03 returned consumer manuals, annual reports and a 2018 notice about phony Attorney General sweepstakes letters (S9).
  • We searched the legislature's index entries, not the full text of every 2025 and 2026 bill.
  • The Idaho State Lottery and Idaho State Police sites were not searched.
