The law

HB 1052 (House Enrolled Act 1052, 2026)

Cited as IC 4-33-10-7; enacted March 12, 2026 (signed by the governor); effective July 1, 2026. [S1]

Adds IC 4-33-10-7, which defines a sweepstakes game as an internet game, contest or promotion, accessible on a mobile phone, computer terminal or similar device, that uses a dual-currency or multi-currency system of payment letting a player exchange currency for a cash prize, cash award or cash equivalents (or a chance to win one) and that simulates lottery games or casino-style gaming, including slot machines, video poker, table games, bingo or sports wagering. Games offered by the state lottery commission and peer to peer skill-based poker games are excluded. The Indiana Gaming Commission may levy a $100,000 civil penalty against an operator or individual who knowingly uses the Internet to conduct a sweepstakes game in Indiana or in a transaction directly involving a person located in Indiana.

“The commission may levy a civil penalty in the amount of one hundred thousand dollars ($100,000) against an operator or individual who knowingly uses the Internet to conduct a sweepstakes game”

Notes

Read the 8 research notes
  • The Governor's 2026 Bill Watch lists HEA 1052 (described as various administrative law matters) as received March 6, 2026, due March 13, 2026 and signed March 12, 2026 (S2).
  • The section takes effect July 1, 2026 per its own heading in the enrolled act (S1). The act also contains an emergency clause (SECTION 43), but the sweepstakes section carries the July 1, 2026 date.
  • The enacted text addresses the operator or individual who conducts the game; it says nothing about players (S1).
  • As introduced on December 5, 2025, the bill's digest described civil and criminal penalties for conducting a sweepstakes game (S3); the House committee version of January 27, 2026 describes civil penalties only (S4), and the enacted act contains only the civil penalty (S1). The House passed the bill on February 2, 2026, 87 to 11 (S5).
  • Operators' Indiana notices, retrieved 2026-10-03: Pulsz's NOTICE FOR INDIANA PLAYERS, created May 13, 2026, says mail-in sweepstakes codes stopped May 4, 2026 and that Sweepstakes Coins expired after June 22, 2026 (S7); High 5 Casino's terms, version 45.0 dated June 26, 2026, say it stopped offering its sweepstakes platform in Indiana and Iowa on June 16, 2026, with play and redemption allowed until June 30, 2026 (S8); Crown Coins' help article dated July 3, 2026 describes a restructured Indiana balance effective June 30, 2026, which it calls “part of a legal update specific to Indiana” (S9).
  • Timeline check: our crackdown timeline describes HB 1052 as a ban with civil penalties “to $100,000”. The enacted text authorizes a civil penalty “in the amount of” $100,000 and does not use the words ban or prohibit (S1). The signing date (March 12, 2026) and effective date (July 1, 2026) match.
  • 2025 HB 1432, an online casino bill, is not listed: its introduced version contains no sweepstakes language (S10), and neither does its House committee version, which we also opened.
  • The Indiana Gaming Commission's orders for the third quarter of 2026 (2026-084 to 2026-123, linked from S6) concern licensees, settlements and debt transactions; none of the orders we could parse mentions sweepstakes (2026-085 is a resolution and 2026-099 did not download as a PDF).

What we could not establish

  • The legislature's bill pages and Indiana Code pages (iga.in.gov) load by script and returned no text to our fetches; bill versions were read from the legislature's PDF links. We could not confirm the Public Law number from a primary document, and could not retrieve Indiana Code text for a general lottery or promotion rule (for example IC 35-45-5-1), so promotion_rules is empty.
  • We did not run a keyword search of all 2025 and 2026 Indiana bills; besides HB 1052 we checked only 2025 HB 1432.
  • No Indiana Gaming Commission or Attorney General action aimed at online sweepstakes casinos was found in the sources checked on 2026-10-03 (the commission's orders index and its illegal gambling page).
  • Private lawsuits by players against sweepstakes-casino operators were not surveyed for this record; they are not state action.
