SF 2289 (2026 Iowa Acts, chapter 1092)
Cited as Iowa Code section 99F.4(13), as amended by SF 2289, section 4; enacted May 15, 2026 (approved by the governor); effective July 1, 2026. [S1]
Adds to the commission's general enforcement power explicit authority to issue cease and desist orders and obtain injunctive relief against a person offering games of chance, gambling, sports wagering or illegal sweepstakes in Iowa without a commission license or other specific legal authorization. The act does not define illegal sweepstakes and does not mention dual-currency or online games. Its other gambling sections raise the commissioners' expense cap, extend lifetime bans to sports wagering and change state income tax withholding on winnings.
“issuing cease and desist orders and obtaining injunctive relief against a person offering games of chance, gambling, sports wagering, or illegal sweepstakes in this state without holding an appropriate license issued by the commission or otherwise being specifically authorized by law”
Rules for any sweepstakes in Iowa
- Promotional games of chance (Iowa Code section 725.12(1)): [S12]
What the rule requires
Iowa's lottery statute allows a commercial organization to advertise a game of chance or contest run “as a promotional activity which is clearly occasional and ancillary to the primary business of that organization”, provided the promotion's effective dates are clearly stated on all promotional materials. A promotion available to the public for more than ninety days within a one-year period is presumed not to be occasional.
- Lottery definition and free entry (Iowa Code section 725.12(3) and (4)): A lottery is a scheme awarding prizes by chance where some or all participants have paid or furnished a consideration. Consideration is not deemed paid where all or substantially all entries are submitted by internet, mail or a similar method before any prize is awarded and a chance to win can be obtained with no purchase or payment. [S12]

Notes

- The bill history lists SF 2289 as signed by the governor on May 15, 2026, assigned Acts chapter 1092, with effective dates of May 15, 2026 and July 1, 2026 (S2); the governor's transmittal letter dated May 15, 2026 approves it (S3). Only the income-tax withholding section took effect on enactment (S1, section 8). The Senate passed it 44 to 0 on February 23, 2026, the House 93 to 0 as amended on April 21, 2026, and the Senate concurred 47 to 0 on April 28, 2026 (S2).
- The introduced bill's explanation says it “grants the commission explicit authority to issue cease and desist orders and seek injunctive relief against persons who offer gambling services in the state without an appropriate license or authorization” (S4). The illegal sweepstakes wording appears in the introduced text and in the enacted text (S4, S1).
- The Iowa Code section 99F.4 PDF served by the legislature on 2026-10-03 still shows the pre-amendment subsection 13, which reads only “To take any other action as may be reasonable or appropriate to enforce this chapter and the commission rules.” (S5).
- In a February 5, 2026 presentation to a legislative subcommittee, the commission listed “Online Sweepstakes casinos” among internet and mobile activity it does not oversee, and a slide on crypto and sweepstakes casinos said “IRGC receives periodic reports or complaints about these” (S6).
- At its June 11, 2026 meeting, staff summarized SF 2289 as including “the authority for the Commission to send cease and desist letters to unlicensed gambling operators in the state”; a commissioner said he believed a cease-and-desist order from the commission would have to be an agenda item voted on at a meeting (S7). The July 24, 2026 minutes and the August 27, 2026 agenda contain no cease-and-desist item (S8, S9).
- The commission's September 3, 2025 consumer warning, issued with the Department of Public Safety, concerns fraudulent online gambling sites and says “Iowa law does not allow for online casinos, slots or poker.” It does not mention sweepstakes (S10).
- High 5 Casino's terms, version 45.0 dated June 26, 2026 and retrieved 2026-10-03, say it stopped offering its sweepstakes platform to participants located in Indiana and Iowa on June 16, 2026, with play and redemption allowed until June 30, 2026 (S13).
- Status label: SF 2289 names “illegal sweepstakes” but does not define the term and does not mention dual-currency or online games (S1). Whether a given dual-currency sweepstakes casino is an “illegal sweepstakes” is not settled by the text, so under this database's status rules the act does not name or clearly cover online sweepstakes casinos and Iowa is labelled none-found. Timeline check: our crackdown timeline lists SF 2289 among state laws against the dual-currency model and describes it as giving the regulator powers over unlicensed operators “including sweeps”; the enacted text reaches persons offering “illegal sweepstakes” in Iowa without a commission license or other specific legal authorization (S1). The signing date (May 15, 2026) and effective date (July 1, 2026) match.
What we could not establish
- We found no commission cease-and-desist order or other action aimed at an online sweepstakes casino in the commission's newsroom (S11) or its 2026 meeting agendas and minutes posted through the August 27, 2026 agenda, checked 2026-10-03; later meeting materials were not available to us.
- SF 2289 does not define illegal sweepstakes, and we found no commission rule or guidance defining it.
- We did not run a keyword search of all 2025-2026 Iowa bills; the related House bill HF 2503 (placed on the House calendar February 16, 2026, with no later action listed) was found only through the SF 2289 history page.
- Status could not be set higher than none-found: the only Iowa statute found that mentions sweepstakes (SF 2289) does not define illegal sweepstakes or mention dual-currency or online games, no commission or Attorney General action aimed at an online sweepstakes casino was found, and no 2025 or 2026 Iowa bill aimed specifically at online sweepstakes casinos was found in the sources checked on 2026-10-03.
