What the record says
The complaint alleges that the defendants' sweepstakes casino websites (the Attorney General's release names Chumba Casino, Global Poker and LuckyLand Slots) are illegal gambling, illegal lotteries and gambling devices under Kentucky law. Its four counts are recovery of gambling losses under the Loss Recovery Act (KRS 372.010 et seq.), unfair and deceptive practices under the Consumer Protection Act (KRS 367.110 et seq., citing KRS 367.170), unjust enrichment, and forfeiture and civil penalties under KRS 528.100. It asks for recovery of every loss of $5 or more within 24 hours by individuals gambling in Kentucky on the websites, treble damages, an injunction barring operation of the sweepstakes casinos in Kentucky, civil penalties of up to $2,000 per willful consumer-protection violation ($10,000 where the person is 60 or older) and $25,000 per gambling device, disgorgement and a writ of prejudgment attachment. These are allegations; no ruling was found.
Rules for any sweepstakes in Kentucky
- Lottery definition (KRS 528.010(8)): [S3]
What the rule requires
Defines a "lottery and gift enterprise" as a gambling scheme in which players pay or agree to pay something of value for chances, the winner is determined by a drawing or other method based on chance, and the holders of winning chances receive something of value; a gift enterprise or referral sales plan meeting those elements is treated as a lottery.
- Gambling definition (KRS 528.010(6)(a)): Defines gambling as "staking or risking something of value upon the outcome of a contest, game, gaming scheme, or gaming device which is based upon an element of chance", in accord with an understanding that someone will receive something of value in the event of a certain outcome. Notes
Read the 4 research notes
- Timeline check: our crackdown timeline (S7) says the Attorney General sued VGW on June 17, 2026 in Franklin Circuit Court, seeking a shutdown and recovery of player losses. The complaint's file stamp (26-CI-00697, 06/17/2026) and its prayer for relief agree (S2).
- The same June 17, 2026 release (S1) announced separate suits against the prediction market platforms Kalshi and Polymarket and their affiliates; those are not sweepstakes-casino actions.
- HB 904 of the 2026 session (2026 Ky. Acts ch. 184), described by the Attorney General's release as the Wagering Consumer Protection Act taking effect July 15, 2026, concerns sports wagering, fantasy contests and related gaming matters (S4, S5). The word sweepstakes appears once in the enacted text, in the existing gambling-device definition covering devices permanently located in a business establishment. We do not count it as an online sweepstakes-casino statute.
- Chumba Casino's Sweeps Rules version 26.1, dated September 16, 2026 and retrieved October 3, 2026, define Permitted Territories as the United States other than 16 named states; Kentucky is not among the 16 (S6).
What we could not establish
- We found no Kentucky statute enacted from 2023 to 2026 that names online sweepstakes casinos or dual-currency games, and no 2025 or 2026 bill on the subject, in the sources checked on 2026-10-03: web searches limited to apps.legislature.ky.gov, the HB 904 record and enacted text, the current text of KRS 528.010, the Legislative Research Commission's 2025 "Gambling" and 2026 "Gaming And Wagering" bill index headings (S8, S9), and trade-press searches. We did not run the Legislative Research Commission's full bill-text search.
- We did not open the Franklin Circuit Court docket. We found no ruling, removal or answer in the VGW case in the sources checked, so its status is recorded as pending.
- The VGW and Yellow Social Interactive class settlements in Henderson Circuit Court mentioned on our timeline are private class actions, not enforcement; we did not re-open their documents.
- The text of KRS 372.020 and 372.040 is taken from the complaint's quotation; we did not open those sections on the legislature's site.
