Bills

  • H.4431 (194th General Court, 2025-2026), An Act relative to internet gaming: accompanied a study order (H.5269, Gaming matters), March 23, 2026. [S1]
    What the bill does

Filed by Representative David K. Muradian, Jr. and referred to the Joint Committee on Economic Development and Emerging Technologies on August 18, 2025; hearing November 13, 2025. The bill would authorize licensed internet gaming under the Gaming Commission and, in section 19 of its new chapter, make it unlawful “to operate, conduct or promote online sweepstakes games within the commonwealth” or to support them, with fines of $10,000 to $100,000 per violation. It defines an online sweepstakes game by a dual-currency system of payment and simulated casino-style gaming. On March 23, 2026 the committee reported a study order (H.5269) that the bill accompanied (history S1, S3; bill text S2).

Rules for any sweepstakes in Massachusetts

  • Electronic sweepstakes machines (Mass. Gen. Laws ch. 271, section 5B): [S5]
    What the rule requires

Makes it unlawful to knowingly possess, with intent to operate, an electronic machine or device to conduct or promote a sweepstakes through an entertaining display (actual or simulated game play), with a fine of up to $250,000 per machine or device placed into operation, up to 15 years in state prison, or both. The section defines a sweepstakes as a game or promotion that “with or without payment of any consideration” a person may enter to win a prize determined by chance, and the covered machines are those owned, leased or possessed by a sweepstakes sponsor or promoter or its affiliates. It exempts activity lawfully conducted by the state lottery commission, pari-mutuel wagering, bingo, charitable gaming, activity under chapters 23K and 23N (casino gaming and sports wagering) and certain grocery promotions. Whether it reaches online platforms is not addressed in the sources we opened.

  • Paid chances to win a prize (attorney general regulation) (940 CMR 30.04 (with 30.02 and 30.05)): [S10]
    What the rule requires

A regulation of the Attorney General under the Consumer Protection Act (chapter 93A) makes it an unfair and deceptive act or practice “for a person to solicit or accept payment for a chance to win a prize.” Where a business or transaction combines a chance to win a prize with a sale of goods or services, it is also unfair and deceptive to engage in it “where a gambling purpose predominates over the bona fide sale of bona fide goods or services”, judged by the criteria in section 30.05. The regulation does not apply to activity expressly authorized by Massachusetts law, such as the state lottery, pari-mutuel wagering, bingo and charitable gaming (scope, S11). The text is quoted from a reprint because the official mass.gov page returned HTTP 403 on October 3, 2026.

Notes

Read the 2 research notes
  • Timeline check: our crackdown timeline lists Massachusetts among states where bills “failed or died”. The primary record shows H.4431 accompanying a study order on March 23, 2026, with no later action listed (S1, S3); we found no recorded floor vote on it.
  • The Legislature's bill search for “sweepstakes” in the 194th General Court returned two documents: H.4431 and H.363, a telemarketing bill that mentions sweepstakes in passing (S4). Searches for “dual-currency” and “sweepstakes casino” returned only H.4431 (S8, S9).

What we could not establish

  • Pages on mass.gov returned HTTP 403 to our requests on October 3, 2026, including the Attorney General's office page and a document titled “June 2026 Consumer Advisory on Legal State-Licensed Gaming” (https://www.mass.gov/doc/responsible-gaming-advisory/download). We therefore could not confirm whether the Attorney General has sent letters to, or sued, any online sweepstakes casino, or what that advisory says about sweepstakes.
  • The Gaming Commission's site search for “sweepstakes” (S6) and its Safer Bets page (S7) showed no action or warning aimed at sweepstakes casinos; the search returned two news clippings.
  • We did not establish whether any other 2025 or 2026 bill (for example a sports wagering or budget bill) carried sweepstakes language outside the Legislature's indexed bill text.
  • 940 CMR 30.00 is cited from the Legal Information Institute reprint (S10, S11) because the official regulation page at https://www.mass.gov/regulations/940-CMR-3000-illegal-lotteries-sweepstakes-and-de-facto-gambling-establishments returned HTTP 403 to our requests on October 3, 2026.
