Bills

  • SB 2510 (2025 Regular Session): died in conference, March 31, 2025. [S4]
    What the bill does

Would have amended section 97-33-8 to bring internet sweepstakes casinos within its prohibitions and raised the penalty from a misdemeanor to a felony. Passed the Senate 51 to 0 on February 13, 2025; the House replaced the text by committee amendment with a version that added mobile sports wagering provisions and passed it 83 to 19 on March 11, 2025; the Senate declined to concur and the bill died in conference March 31, 2025 (votes: S5, S6; House committee amendment: S7).

  • SB 2104 (2026 Regular Session): died in committee, March 3, 2026. [S8]
    What the bill does

Would have declared “online sweepstakes casino-style games” to be gambling devices, added “online sweepstakes casinos” to section 97-33-8, made promoting or operating one a felony with fines up to $100,000 and up to ten years, and authorized forfeiture. Passed the Senate 52 to 0 on February 4, 2026; died in the House Gaming Committee March 3, 2026 (text: S9; vote: S10).

Enforcement

  • June 17, 2025, Mississippi Gaming Commission: cease-and-desist letters against Online sports wagering and casino sites; the notice as posted does not name them. Press reports list 10 recipient sites, including chumbacasino.com (S3, S11, both secondary).. Status: issued. [S1]
    What the record says

The Commission's notice says letters went to companies “operating sports wagering and/or online casinos” in Mississippi and that “there are no legal exceptions for online sports books or so-called “sweepstakes” casinos.” It warns that a player could face criminal prosecution and forfeiture of deposits, and points to loss recovery under Miss. Code Ann. section 87-1-5.

Rules for any sweepstakes in Mississippi

  • Sweepstakes devices and the promotion exemption (Miss. Code Ann. section 97-33-8): [S9]
    What the rule requires

Section 97-33-8, as it reads before the changes proposed in 2026, makes it unlawful to operate or have a financial interest in an electronic video monitor offering a “simulated gambling program” for direct or indirect consideration, which “includes consideration paid for internet access or computer time, or a sweepstakes entry”, where the player may win a cash or cash-equivalent prize; a violation is a misdemeanor. The section exempts “Any lawful marketing promotion, contest, prize or sweepstakes that is designed to attract consumer attention to a specific product or service” offered for sale by its maker or seller. The existing-law text is taken from SB 2104 (2026), which prints current law with proposed changes marked.

Notes

Read the 4 research notes
  • Timeline check: our crackdown timeline says Mississippi's commission “named 10 operators in a June 2025 public notice”. The Commission's notice dated June 17, 2025, as posted and linked from its homepage on 2026-10-03 under the title “Cease and Desist letters issued to Illegal Operators,” gives neither names nor a count; it says letters went to “multiple online gambling sites” and that a list of unlicensed sites is on the Commission's website (S1, S2). The count of 10 and the recipient names come from press reports: Casino Reports says the Commission sent 10 letters, including to Chumba Casino (S3), and a WJTV report dated June 18, 2025 lists ten sites it says the Commission identified, including chumbacasino.com (S11). The timeline line should read as press-reported unless the list is located.
  • Timeline check: the timeline says bills failed or died in Mississippi in 2025 and 2026; the Legislature's bill status pages agree (S4, S8).
  • SB 2104 would also have created section 97-33-6, a safe harbor for internet, cable and telecommunications providers and app stores (S9).
  • Other bills: the Legislature's all-measures indexes for the 2025 and 2026 regular sessions list no other measure whose title mentions sweepstakes; the mobile sports wagering bills we opened (2025 SB 2379, 2026 SB 2249 and HB 4074) mention sweepstakes only in the existing text of section 97-33-8 that they reprint (S12, S13, S14).

What we could not establish

  • The list of unlicensed gaming sites that the June 17, 2025 notice says is on msgamingcommission.com was not found on the homepage or the illegal-gambling report page on 2026-10-03, so the recipients are not confirmed from a primary source.
  • We found no Legislature-run site publishing the Mississippi Code; the section 97-33-8 text is reconstructed from the existing-law portion of SB 2104 (passed Senate version) and was not checked against an official code compilation; SB 2379 (2025), as introduced, brings the section forward with the same exemption wording (S14).
  • We did not find an Attorney General action on online sweepstakes casinos in the sources checked on 2026-10-03.
