Rules for any sweepstakes in Nebraska

  • No-purchase and disclosure rules for business sweepstakes (gift enterprises) (Neb. Rev. Stat. 9-701, as amended by LB1001 (2026), operative July 1, 2026): [S1]
    What the rule requires

A gift enterprise is a contest, game of chance or game promotion run in connection with the sale of consumer or trade products or services solely as a business promotion. The operator may not require an entry fee or any other consideration to enter or win, except proof of a purchase whose price is not raised because of the promotion; filling out an entry blank and entering by mail at no more than first-class postage are not consideration. The operator must disclose all terms and conditions, may not rig the game or arbitrarily reject entries, must award the prizes offered, and may not use false or misleading advertising. A violation is a Class II misdemeanor and can also bring a civil penalty of up to $1,000 per violation, and the Department of Revenue may sue to enjoin a gift enterprise it has reason to believe is operating in violation of the section. The definition excludes bingo, keno, slot machines and any non-telecommunication-related, player-activated electronic or electromechanical facsimile of a game of chance.

Notes

Read the 3 research notes
  • LB1001, approved by the governor on March 16, 2026, amended section 9-701 among other racing and gaming changes; its section 40 makes the act operative July 1, 2026 (S1).
  • Full-text keyword searches of 109th Legislature (2025 and 2026) documents on the legislature's site found the word sweepstakes only in LB609, a 2025 cryptocurrency-kiosk fraud act whose required consumer warning mentions sweepstakes scams; a search for online casino returned only LB421 and LB438, two 2025 bills to authorize online sports wagering, and LB1001. None of these addresses online sweepstakes casinos or dual-currency games (S2, S3, S6).
  • A Nebraska Attorney General release dated August 5, 2025 says Attorney General Mike Hilgers co-led a bipartisan coalition of 50 attorneys general in a letter, dated August 4, 2025, asking the U.S. Department of Justice to help curb illegal offshore gaming. Neither the release nor the letter mentions sweepstakes or social casinos (S4).
