Rules for any sweepstakes in New Hampshire

  • When a sweepstakes entry counts as something of value (N.H. Rev. Stat. Ann. section 647:2, I and II(d)): [S1]
    What the rule requires

In the gambling statute, “something of value” includes a sweepstakes ticket or other item obtained with a purchase of goods or services that entitles the holder to a chance in a sweepstakes where, but for the chance to enter, the value of the purchased goods or services is insufficient to justify the purchase, or the inducement to buy is the chance to play a gambling machine. Under paragraph I, a person who knowingly and unlawfully gambles, permits gambling in a place under the person's control, or possesses a gambling machine is guilty of a misdemeanor.

  • Statutory definition of sweepstakes (N.H. Rev. Stat. Ann. section 647:2, II(h)): [S1]
    What the rule requires

The same section defines a sweepstakes as any game, advertising scheme or plan, or other promotion which, with or without payment of any consideration, a person may enter to win a prize determined by chance, and limits the term, for that chapter, to sweepstakes that an entrant can enter, play or interact with “using a gambling machine furnished by the sweepstakes operator” or an affiliate or contractor, in an establishment the operator controls, is affiliated with or contracts with.

Notes

Read the 2 research notes
  • SB 168 (2025), a bill to regulate online gambling, contains no reference to sweepstakes in the introduced text we opened (S6). Its Senate status reads “DIED ON THE TABLE” as of November 3, 2025 (S7).
  • Section 647:2 was last amended by 2026, 322:2, effective July 15, 2026 (S1). That amendment, in HB 1194, rewrote paragraph V(f) to exempt “The conduct of a sports book, or participation in sports wagering, authorized by RSA 287-I” and does not concern sweepstakes (S8).

What we could not establish

  • Bill coverage is a title search of the General Court bill status system: “sweepstakes” returned “Bills Found : 0” for both 2025 and 2026 (S2, S3), and “gambling” returned only SB 168 (2025) and HB 1194 (2026) (S4, S5). Further title searches on October 3, 2026 for casino, gaming, games of chance, lottery, online, wager and prize in 2025 and 2026 (same search form as S2) returned no bill on sweepstakes or online sweepstakes casinos. The system offers no full-text search through the interface we used, so a bill whose title does not use these words could be missing.
  • The New Hampshire Department of Justice site (doj.nh.gov) returned HTTP 403 to our requests on October 3, 2026, so we could not search Attorney General releases for action against sweepstakes casinos. The Lottery Commission site search is rendered by script and returned no readable results.
