The law

SB 1589 (Laws 2026, c. 394)

Cited as 21 O.S. section 941; enacted May 14, 2026 (veto overridden: Senate 34 to 10 and House 68 to 19, both on May 14, 2026; the Senate Journal records the governor's veto as dated May 7, 2026); effective November 1, 2026. [S1]

Amends Oklahoma's gambling statute. It defines "online casino games" as internet games, on devices including phones, smart watches and tablets, that upon risking any representative of value simulate a gambling game, and defines "representative of value" to include currency in a dual-currency system that can be exchanged for a prize, cash or cash equivalent. Anyone who opens, conducts or carries on such games, or who as owner, employee, geolocation provider, gaming supplier, platform provider, promoter or media affiliate deals or provides support for them, is guilty of a Class C2 felony, with a fine of $500 to $2,000 plus imprisonment under 21 O.S. section 20M. Games under the Oklahoma Charity Games Act and tribal gaming conducted under the federal Indian Gaming Regulatory Act are excepted. Section 2 of the enrolled bill reads: "This act shall become effective November 1, 2026."

“any and all currency used as part of a dual-currency system of payment that allows a person to exchange such currency for any prize, award, cash, or cash equivalent”

Players: The amended section does not use the words player or bettor. A separate section that SB 1589 does not amend, 21 O.S. section 942 (S4), makes it a misdemeanor for "Any person who bets or plays at any of said prohibited games", punishable by a fine of $25 to $100, one to 30 days in county jail, or both. We draw no conclusion about whether or how that section applies to online sweepstakes play.
