Rules for any sweepstakes in South Carolina

  • Prize promotion disclosures and fees (S.C. Code Ann. sections 37-15-40, 37-15-70 and 37-15-90): [S1]
    What the rule requires

Under the Prizes and Gifts Act, anyone who, in connection with a sale or lease, tells a person they have a chance to win must clearly disclose who runs the promotion and all material conditions, including each prize's actual retail value, the number of each prize and the odds. A separate section bars requiring payment of excessive shipping or handling charges as a condition of receiving a prize; a violation is an unfair trade practice. Section 37-15-40(D) says that section does not apply where a participant is asked only to complete and mail or deposit an entry blank, or call in an entry, or is never required to listen to a sales presentation to receive the prize, or is never required to pay for anything other than as disclosed in the award rules.

Notes

Read the 3 research notes
  • A search of 2025-2026 (Session 126) legislation on the Legislature's site for “sweepstakes” returned one match, a resolution honoring a high school marching band; searches for “dual currency,” “online casino,” “simulated gambling” and “internet gambling” returned none (S2).
  • H. 4176 (2025), titled Gaming Commission, was introduced March 6, 2025, reported by the House Ways and Means Committee April 30, 2025, and recommitted to that committee January 28, 2026, where it sits; the retrieved text does not contain the word sweepstakes (S3).
  • Our crackdown timeline does not mention South Carolina; nothing here conflicts with it.

What we could not establish

  • The Attorney General's site search for “sweepstakes” did not return a results list on 2026-10-03; the negative on enforcement rests on that attempt and on web searches, not on a full review of the office's releases.
  • We found no South Carolina gaming regulator with authority over online play; no agency list of unlicensed sites was found.
