Notes

Read the 3 research notes
  • South Dakota's internet gambling chapter, enacted in 2000, bars a person engaged in a gambling business from using the internet to bet or wager and bars anyone from establishing a location or site in the state to conduct a gambling business over the internet; a first offense is a Class 6 felony, and the Attorney General may notify a gambling business that its website is illegal in the state (S2, S3, S4, S5). The chapter does not mention sweepstakes.
  • On August 4, 2025 the South Dakota Commission on Gaming alerted the public to fraudulent online casinos falsely claiming to be affiliated with licensed South Dakota gaming establishments, some imitating the branding of Deadwood and tribal casinos, and stated that under South Dakota law any online platform offering casino-style games such as slots, table games, sports wagering or digital card games is not authorized (S6). The alert does not mention sweepstakes casinos, so it is not listed as enforcement aimed at them.
  • Bill titles in the 2025 and 2026 sessions include video lottery limits, gaming revenue distribution, online pari-mutuel wagering licensure, bingo for booster clubs and proposed constitutional amendments on mobile sports wagering; none concerns online sweepstakes casinos (S7).

What we could not establish

  • The Attorney General's site search for sweepstakes returned an error page on 2026-10-03. The press release list as served covers October 6, 2025 to October 2, 2026 and contains no item about sweepstakes casinos or online gambling; earlier releases were not reviewed (S8).
  • We filtered bill titles, not full bill text.
  • The Department of Revenue site search (dor.sd.gov/search) returned no results for sweepstakes and also for the control term casino on 2026-10-03, so it was not a usable check of the Commission on Gaming's own pages.
