The law
SB 2136 / HB 1885 (Public Chapter 1117, 2026)
Cited as Tenn. Code Ann. sections 47-18-5901 to 47-18-5904 (new part added by Pub. Ch. 1117, section 1); enacted May 22, 2026 (signed by the governor; Public Chapter number assigned May 27, 2026); effective May 22, 2026. [S1]
Defines an “online sweepstakes game” as gambling in a game, contest or promotion that is available on the internet, uses a virtual, dual or multi-currency system in which a currency that is bought, received as a bonus, or received free with another purchase can be exchanged for a prize or cash, and simulates gambling such as slots, table games, lottery games, bingo or unlicensed sports wagering. Declares the operation, conducting or commercial promoting of such games unlawful, makes a violation an unfair or deceptive act under the Tennessee Consumer Protection Act of 1977, reaches anyone who supports, facilitates or assists in their operation, and expands the Attorney General's investigative powers. Section 11 says the act takes effect upon becoming a law.
“the operation, conducting, or commercial promoting of online sweepstakes games and other forms of online or app-based gambling are unlawful”
Players: The remedies in section 47-18-5902(b) attach to a person who offers or accepts wagers or entry fees, operates or commercially promotes online sweepstakes games, sells or hosts gambling devices, or supports or facilitates their operation; that list does not name players. Subsection (a) states that gambling is unlawful.
Bills
- SB 2136 / HB 1885 (114th General Assembly, 2026): enacted as Public Chapter 1117, May 22, 2026. [S2]
What the bill does
Passed the Senate 32 to 0 on March 2, 2026 and the House as amended 67 to 20 on April 21, 2026; the chambers adopted a conference committee report on April 23, 2026 (Senate 25 to 5, House 69 to 17); signed by the governor May 22, 2026.
Enforcement
- October 23, 2025, Tennessee Sports Wagering Council: cease-and-desist letters (announced in a release) against ReBet (named in the same release as BetWhale.ag and Kickr). Status: issued. [S7]
What the record says
The Council's release says ReBet “offered social sportsbook sweepstakes” and that ReBet, BetWhale.ag and Kickr “have all shut down these offerings after the SWC issued cease and desist letters”. The release concerns sports-related offerings, not casino-style games.
- December 29, 2025, Tennessee Attorney General and Reporter: cease-and-desist letters against 38 brands listed in the release, from American Luck to Zula Casino (full list in notes). Status: issued. [S5]
What the record says
The release says the office sent formal cease-and-desist letters to “almost forty online sweepstakes casinos” and that every recipient had disabled the components the office called unlawful or agreed on a wind-down date. It states the office's position that the promotional sweepstakes model “constitutes an illegal lottery prohibited by the Tennessee Constitution”.
Rules for any sweepstakes in Tennessee
- Lottery prohibition (Tenn. Const. art. XI, section 5): [S6]
What the rule requires
The state constitution bars the legislature from authorizing lotteries other than the state education lottery and certain annual charitable events approved by a two-thirds vote, and directs it to prohibit the sale of lottery tickets: “The Legislature shall have no power to authorize lotteries for any purpose, and shall pass laws to prohibit the sale of lottery tickets in this state”. The Attorney General's December 29, 2025 release says the sweepstakes model “constitutes an illegal lottery prohibited by the Tennessee Constitution” but does not cite a section (S5).

- Timeline check: our crackdown timeline lists SB 2136 / HB 1885 as signed May 22, 2026 with the effective date left unstated. The General Assembly's bill page records “Effective date(s) 05/22/2026” and Public Chapter 1117 assigned May 27, 2026, and section 11 of the act says it takes effect upon becoming a law (S1, S2). The signature date agrees.
- Timeline check: the timeline says the Attorney General announced letters to nearly 40 platforms on December 29, 2025. The release says “almost forty” and names 38 brands (S5).
- The Fiscal Review Committee memorandum dated February 13, 2026 rated the fiscal impact of the bill as amended “NOT SIGNIFICANT” (S4). The enacted text is the conference committee version (S3).
- The Sports Wagering Council also announced that Legendz, “an online social entertainment platform that offered a social sportsbook,” stopped offering those services in Tennessee on April 8, 2025 after the Council sent it a letter about potential violations of the Tennessee Sports Gaming Act (S8), and that Sportzino “has shut down its sports-related sweepstakes operations in Tennessee” (release dated September 18, 2025, which does not say what action preceded the exit) (S9). Both concern sports wagering offerings.
- “Chanced” is one of the online sweepstakes casinos named in the Attorney General's December 29, 2025 release. It is not Chance Infinite, the app operated by this site's publisher, Luck Incorporated LLC; Chance Infinite does not appear in the release (S5).
What we could not establish
- We found no Tennessee enforcement action under Public Chapter 1117 itself (lawsuit or settlement) in the sources checked on 2026-10-03; the Attorney General's site was checked only for the December 2025 release, and the Sports Wagering Council's newsroom list was reviewed (S10).
- We found no other 2025 or 2026 Tennessee bill on online sweepstakes casinos in a web search limited to capitol.tn.gov; the General Assembly's keyword search was not run directly.
- We found no state-run site publishing Tennessee Code Annotated; the act text is cited from the Secretary of State's Public Chapter PDF, which is a scanned image with some OCR errors (for example subsection (B) reads as (8)).
