Rules for any sweepstakes in Texas
- Lottery definition (Tex. Penal Code section 47.01(7)): Defines a lottery as "any scheme or procedure whereby one or more prizes are distributed by chance among persons who have paid or promised consideration for a chance to win anything of value", whatever it is called. [S4]
- Mail sweepstakes rules (Tex. Bus. & Com. Code sections 622.051, 622.052, 622.101, 622.202 and 622.205): [S5]
What the rule requires
Chapter 622 applies only to sweepstakes conducted through the mail whose most valuable prize is worth $50,000 or more. Such a sweepstakes may not require an order or purchase to enter or automatically enter purchasers, and section 622.101(a) bars an entry mechanism that is connected to ordering, is not identical for all entrants, and lacks the printed statement beginning "Buying Will Not Help You Win." The Attorney General may sue for civil penalties of $5,000 to $50,000 per violation; there is no private right of action.

Notes
Read the 3 research notes
- SB 517 of the 89th Legislature (2025) passed the Senate on May 8, 2025 and was received in the House the same day, its last recorded action (S1). Its engrossed text would have amended the Penal Code definitions of "gambling device" and "thing of value" (adding gift cards and other representations of value) and raised several gambling offenses to third-degree felonies (S2). The text does not mention the internet, online play or sweepstakes. Trade press (S6, secondary) suggested its definitions could affect online sweepstakes platforms. We do not count it as a sweepstakes-casino bill.
- The legislature's GAMBLING subject report for the 89th Regular Session lists 19 measures (S3). None of their captions mentions sweepstakes or online play, and the introduced texts of HB 487, HB 2996 and HB 4132 that we opened do not contain the words sweepstakes, internet or online (S7, S8, S9).
- Our crackdown timeline does not mention Texas.
What we could not establish
- We did not obtain bill lists for the 2025 called (special) sessions; the subject-report URLs we tried for them returned no data.
- We found no Texas Attorney General action aimed at online sweepstakes casinos in a search of texasattorneygeneral.gov on 2026-10-03.
- statutes.capitol.texas.gov now serves a JavaScript application; statute text was retrieved from the legislature's tcss.legis.texas.gov resource files.
