Rules for any sweepstakes in Utah

  • When a business promotion becomes fringe gambling (Utah Code 76-9-1401(6), (16)): [S4]
    What the rule requires

Utah defines fringe gambling as any de facto form of gambling, lottery, fringe gaming device or video gaming device offered by a business in exchange for anything of value or incident to the purchase of another good or service. A promotion is excluded only if it is clearly ancillary to the business, which the statute says requires, among other things, that it run for a limited time, not require a purchase to participate or gain an advantage, and not, through a machine or device, simulate a gambling environment, look or operate like a casino machine, show casino-style game displays, or create a pretextual transaction to facilitate a sweepstakes.

  • Lottery definition (Utah Code 76-9-1401(8)(b), (13)): A lottery is any scheme for distributing property by chance among persons who have paid or promised to pay valuable consideration for the chance, whether called a lottery, raffle or gift enterprise; lotteries fall within Utah's definition of gambling. [S4]

Notes

Read the 5 research notes
  • Utah's criminal code defines online gambling as gambling, fringe gambling or gaming by use of the internet or a mobile device (S4). Participating in gambling, fringe gambling or online gambling is a class B misdemeanor for a first offense (S5), and intentionally providing or offering online gambling to an individual in Utah is a third degree felony (S6). Section 76-9-1404 shows as enacted by chapter 173 of the 2025 General Session, which renumbered Utah's gambling provisions; we did not establish when its substance was first enacted. These provisions do not name sweepstakes casinos or dual-currency games.
  • Utah Code 76-9-1412 lets an individual who suffers an economic loss from a fringe gaming device, video gaming device or gambling device or record sue the operator or a person receiving revenue from it and recover twice the loss (S7). Covers reported on November 4, 2025 that at least 15 class actions against sweepstakes casino operators had been filed in Utah within the previous week, and pointed to the state's double-damages provision as a reason (S11, secondary). We did not pull the dockets, and the outcome of those suits is not established here.
  • HB 243 (2026 General Session), Gambling Revisions, was signed by the governor on March 25, 2026 and took effect May 6, 2026 (S1, S2). Its enrolled text adds a definition of proposition bet and states that gambling includes a proposition bet; it does not mention dual-currency games or online sweepstakes casinos. Gambling Insider reported, in an article marked as updated January 14, 2026, that HB 243 would place sweepstakes-style and dual-currency casino platforms under fringe gambling (S10, secondary). The fringe gambling and promotional-activity definitions that article quotes already appear in the version of Utah Code 76-9-1401 effective May 7, 2025, before HB 243 (S3), so we do not treat HB 243 as a sweepstakes-casino bill.
  • SB 38 (2026 General Session), Consumer Protection Modifications, was signed March 17, 2026 (S8). It renumbers and amends Division of Consumer Protection statutes; its enrolled text contains no reference to casinos or gambling, and its one use of the word sweepstakes concerns telecommunications provider change authorizations. The same Gambling Insider article described it as giving regulators new tools against sweepstakes operators (S10, secondary).
  • Utah's 2025 and 2026 bill lists show HB 243 as the only bill with gambling in its title (S9).

What we could not establish

  • No Utah Attorney General or Division of Consumer Protection action aimed at online sweepstakes casinos was found. A site search of attorneygeneral.utah.gov for sweepstakes on 2026-10-03 returned two scam-warning posts (S12); the Division of Consumer Protection site search URL we tried returned a 404 page, and a search of commerce.utah.gov, which hosts the Division's pages, returned scam-education pages for sweepstakes and nothing for casino (S13).
  • An aggregator claim that Utah's Attorney General issued subpoenas to sweepstakes casino operators in 2025 could not be traced to a primary document and is not used.
  • Text extracted from Utah bill PDFs does not preserve underlining, so new language was identified from the bill's own highlighted provisions and by comparing code versions effective May 7, 2025 and May 6, 2026.
