  • Gambling Commission position: a statement titled Regarding Virtual Casinos, posted as an undated web page and linked as a PDF dated January 21, 2025 (S1, S15), summarizes Kater v. Churchill Downs (9th Cir. 2018) and Larsen v. PTT, LLC, says "games of chance such as those in Kater and Larsen that ask the player to wager virtual currency for the potential of winning more virtual currency are likely to constitute illegal gambling", and states that "WSGC encourages all companies that offer virtual casino games to Washington residents to review their games and ensure compliance with Washington State law" (S1). The statement does not mention sweepstakes or name an operator, so we do not list it as an enforcement action.
  • The Commission's Sweepstakes FAQ says sweepstakes marketed online by some businesses as a legal alternative to raffles combine elements of raffles and promotional contests of chance into a third type of contest that is not authorized in Washington, and that in Washington law the word sweepstakes refers only to golfing and bowling sweepstakes (S2). Its online gambling FAQ says "you are violating Washington State law if you knowingly gamble through an online gambling website" (S3).
  • RCW 9.46.240, last amended in 2020, provides that whoever knowingly transmits or receives gambling information by means including the internet "shall be guilty of a class C felony", except for activities authorized by the gambling chapter (S4). It predates the period this database tracks and does not mention sweepstakes.
  • Larsen v. PTT, LLC, No. 3:18-cv-05275 (W.D. Wash.), is a private class action, not regulator enforcement, filed in 2018 against PTT, LLC, doing business as High 5 Games (S9). The class certified on January 21, 2021 was individuals in Washington who purchased virtual coins in High 5 Casino or High 5 Vegas after April 9, 2014 (S10). On June 11, 2024 the court granted partial summary judgment holding High 5 liable to the damages class under the Recovery of Money Lost at Gambling Act (RCW 4.24.070) and the Consumer Protection Act; the order states that "High 5 is liable as a matter of law for damages pursuant to the RMLGA" (S10). A jury returned its verdict on February 7, 2025 (the verdict form is sealed). On June 11, 2025, after denying High 5's motion to vacate the enhanced damages award or apply a statutory cap, the court entered judgment on the jury's verdict for the damages class of $24,928,712.17 ($17,742,855.64 actual and $7,185,856.53 enhanced damages) (S9, S11). Claims against High 5 Entertainment LLC for its own operations after it took over the games were dismissed without prejudice for lack of standing on December 12, 2024 (S9).
  • Larsen settlement: on August 14, 2026 the court preliminarily approved a class settlement for individuals in Washington who played or purchased virtual coins on the High 5 Casino or High 5 Vegas apps after April 9, 2014 and before October 1, 2022, with "a non-reversionary Settlement Fund with a minimum value of $12,000,000 and a maximum of $30,000,000"; that order set the claims, objection and exclusion deadlines for November 13, 2026 and the final approval hearing for December 14, 2026, and names the settlement website as www.high5lawsuit.com (S12). On September 10, 2026 the court entered an order on a motion to continue that reset deadlines or hearings (docket entry 732; its text is not in the free archive) (S9). As of October 3, 2026 the settlement website gives January 4, 2027 as the deadline to file a claim, exclude yourself or object, and February 8, 2027 for the final approval hearing, and states that the defendants deny all claims (S16). The settlement is not final until approved.
  • Timeline check: our crackdown timeline says a federal jury in Larsen v. PTT, LLC awarded roughly $24.9 million in February 2025, following a 2024 summary judgment under Washington's gambling-loss recovery and consumer-protection laws. The docket matches: summary judgment June 11, 2024, verdict February 7, 2025, judgment of $24,928,712.17 entered June 11, 2025 (S9, S10, S11). The docket also shows that the judgment, including the enhanced damages, was entered on the jury's verdict (S9). The timeline does not yet mention the August 2026 preliminary settlement approval or the current January 4, 2027 claim deadline (S12, S16).
  • High 5 Casino's Terms of Use, Version 45.0 dated June 26, 2026, retrieved October 3, 2026, list Washington among the Restricted Territories for both its sweepstakes platform and its Gold Coin-only Classic platform, and include this notice: "FOR PLAYERS LOCATED IN THE STATE OF WASHINGTON: BY ACCEPTING THIS ARBITRATION PROVISION, YOU GIVE UP ANY RIGHT TO PARTICIPATE IN OR OBTAIN ANY RELIEF IN THE FOLLOWING PENDING ACTION", followed by a case identified with the same case number as Larsen (S13). Read together with the docket, that is the Larsen case under an earlier caption.

What we could not establish

  • Bill coverage is the Legislature's web service list of all 5,245 legislation records introduced in the 2025-26 biennium, matched on short and long descriptions: none mentions sweepstakes; the gambling-related measures concern Gambling Commission records, a diversion court, bingo, electronic raffles at sporting events, lottery promotional entries and sports wagering (S8). Of these, HB 1222 (Gambling Commission records, effective July 27, 2025) and SB 6137 (the regulated sports wagering industry, Chapter 246, Laws of 2026, effective June 11, 2026) were enacted (S8); SB 6137's text contains no occurrence of the word sweep (S17). Other bill texts were not read.
  • We found no Gambling Commission order, release or letter naming a sweepstakes casino. Its all-press-releases listing for 2022 through 2026 shows one cease-and-desist release, a second notice to Bovada.lv on September 19, 2025, and a December 9, 2025 item on prediction markets (S14). The Commission's site search returned no results for sweepstakes even though its Sweepstakes FAQ and a June 2025 Sweepstakes Scam Alert exist, so it is not a reliable negative (S7). The Attorney General's site was not searched in depth (its search page returned no usable results to a scripted query).
  • The Regarding Virtual Casinos web page carries no date; the PDF of the statement linked from it is dated January 21, 2025 (S15). We did not establish whether an earlier version existed.
