Enforcement

  • 2025-xx-xx, West Virginia Attorney General: subpoenas (reported by the press; no primary document found) against Sweepstakes casino operators, not named in the report. Status: issued. [S1]
    What the record says

WV News reported on July 14, 2025 that "Attorney General John McCuskey recently announced that his office issued 47 subpoenas to sweepstakes casino operators", and that although none had responded formally, more than 20 platforms had withdrawn from the state. The report does not say when the subpoenas were issued. We found no Attorney General release or filing on the subpoenas, so this entry rests on secondary reporting.

Rules for any sweepstakes in West Virginia

  • Lottery offense (W. Va. Code section 61-10-11): [S4]
    What the rule requires

Makes it a misdemeanor, punishable by up to one year in jail, a fine of up to $1,000, or both, to set up, promote or help manage or draw a lottery or raffle for money or other thing of value, or to sell or hold for sale lottery chances, tickets or devices entitling a person to a prize drawn in a lottery. The section states that it does not apply to the forms of lottery known as "policy" or "numbers", which section 61-10-11a addresses separately.

  • Prize notices (W. Va. Code sections 46A-6D-1 and 46A-6D-3): [S5]
    What the rule requires

Under the Prizes and Gifts Act, a person may not, in connection with a sale or solicitation, tell someone they have won anything of value or are a contest winner unless the prize is given without obligation and delivered at no expense to the recipient within ten days; phrases such as "Congratulations" or "You have won" count as such a representation.

Notes

Read the 3 research notes
  • In a statement quoted by Casino Reports (secondary; article first published January 29, 2025 per the page metadata, updated June 18, 2026), the Attorney General said: "We have serious concerns about West Virginia consumers, specifically our children, being targeted by illegal gambling operations," adding that his office could not comment on specific cases. The same article reported, citing an unnamed source, that the Attorney General was preparing to either subpoena or send cease-and-desist letters to sweepstakes operators. (S2)
  • On August 5, 2025 the Attorney General announced that he joined a 50-attorney-general letter urging the U.S. Department of Justice to address illegal offshore gambling; the release does not mention sweepstakes casinos. (S6)
  • Comparison with our crackdown timeline: it says the Attorney General "issued 47 investigative subpoenas beginning February 2025, after which more than 20 platforms quietly left the state, per trade coverage." The report we opened supports the 47 subpoenas and the more than 20 departures, but gives no start month; we could not confirm "beginning February 2025" from it or from any state document. The Casino Reports article of January 29, 2025 (S2) described subpoenas or letters as being prepared, which is consistent with, but does not establish, a February 2025 start. (T1, S1, S2)

What we could not establish

  • No primary document for the subpoenas: the Attorney General's news listing, read back to January 13, 2025 (148 articles), contains no release on sweepstakes casinos. (S3)
  • The West Virginia Lottery Commission's website renders by script and could not be searched by our client; we found no Lottery Commission action on sweepstakes casinos.
  • The Legislature's 2025 and 2026 regular-session bill lists contain no bill whose title concerns sweepstakes casinos or dual-currency games; the 2026 rule bills on interactive wagering (SB 296, HB 4249) were identified by title; SB 296's introduced text, opened 2026-10-03, only authorizes the Lottery Commission's interactive wagering rule and does not mention sweepstakes, and the rule text itself was not read. HB 4343 (2026, "Individual Gaming Restrictions") amends the resort gaming facility entry rules in section 29-25-24 and does not mention sweepstakes. (S7, S8)
