Rules for any sweepstakes in Wisconsin
- Lottery definition and what is not consideration (Wis. Stat. 945.01(5)): [S2]
What the rule requires
A lottery is “an enterprise wherein for a consideration the participants are given an opportunity to win a prize, the award of which is determined by chance, even though accompanied by some skill.” In any game, drawing, contest, sweepstakes or other promotion, listed acts are not consideration, including listening to or watching a broadcast, and filling out a mailed or published entry form if facsimiles or handwritten entries are accepted or if no purchase is required.
- Prize notices (Wis. Stat. 100.171): [S3]
What the rule requires
If a solicitor tells a person they have been selected or may be eligible to receive a prize, no payment may be requested or accepted before the person receives a written prize notice with the solicitor's and sponsor's names and addresses, the verifiable retail value of each prize and, where several prizes are listed, the odds of receiving each. Notices of a prize actually won through a prior entry in a game, drawing, sweepstakes or other contest are excluded.

Notes
Read the 3 research notes
- The Legislature's search of the 2025 biennium for sweepstakes returned statutes and two bills, AB 606 and SB 681, whose hits concern hemp-derived cannabinoid regulation and alcohol-premises promotions; neither concerns online sweepstakes casinos (S1). Searches for dual-currency returned no results (S4).
- The Division of Gaming describes its role as regulating Indian and charitable gaming (S5).
- The statute history of Wis. Stat. 945.01 lists 2025 Wisconsin Act 247 (S2). That act, enacted April 9, 2026, creates 945.01(1)(h) to exclude certain event or sports wagers placed through servers on tribal lands from the definition of bet; it does not mention sweepstakes (S6).
What we could not establish
- We could not run a keyword search of the Wisconsin Department of Justice's releases (the site's search is script-driven), and a general web search run on 2026-10-03 surfaced no report of one; no Attorney General or regulator action aimed at online sweepstakes casinos was found in the sources checked on 2026-10-03, which is a bounded negative.
- The search covered the 2025 biennium only; earlier bienniums were not searched.
